Terms of service

These terms govern the use of InstaClock, a staff attendance service provided by InstaWebsite ("we", "us"). By creating an organisation account or using InstaClock you agree to these terms on behalf of your business ("you", the "customer").

1. The service

InstaClock provides staff clock-in and attendance tools: kiosk and phone clock-in, GPS geofence checks at the moment of clocking, shift scheduling, timesheets, payroll exports, alerts and audit trails. We may improve or change features over time; we will not materially reduce the core service during a paid term without reasonable notice.

2. Accounts and trials

You must provide accurate registration details and keep account credentials secure. New organisations receive a 10-day free trial with no payment details required. After the trial, continued use requires an active subscription; current pricing is published on instawebsite.co.uk/staff-clock-in.

3. Acceptable use

You agree not to:

  • use InstaClock other than for lawful workforce attendance purposes;
  • attempt to access another organisation's data, probe or circumvent security controls, or interfere with the service's operation;
  • use the service to monitor people outside a legitimate employment relationship, or in a way that breaches UK data protection or employment law;
  • resell or provide the service to third parties without our agreement.

You are responsible for telling your staff how attendance monitoring works and for meeting your own legal obligations as an employer and data controller.

4. Your data

You own your data. Attendance records, staff details and related content belong to your organisation. We process them only to provide the service, as described in our privacy policy. You can export your data at any time using the built-in export tools, and you can delete it — or ask us to — when you leave. We keep routine backups for service continuity, which expire on a rolling basis.

5. Cancellation

You may cancel at any time. Cancellation takes effect at the end of the current billing period, and you keep access until then. After cancellation we make your data available for export for a reasonable wind-down period before deletion.

6. Availability and support

We aim to keep InstaClock available around the clock but do not guarantee uninterrupted operation; maintenance windows and events outside our control can cause downtime. Support is provided in English during UK business hours.

7. Liability

Nothing in these terms limits liability that cannot be limited under law (including for death or personal injury caused by negligence, or fraud). We are not liable for indirect or consequential loss, loss of profits, or loss of data caused by factors outside our reasonable control. Our total aggregate liability arising out of the service in any 12-month period is limited to the amount you paid for the service in that period. InstaClock records attendance; you remain responsible for payroll decisions and for verifying exported data before use.

8. Changes to these terms

We may update these terms from time to time. If a change is material we will give at least 30 days' notice by email or in-app notice. Continued use after the change takes effect constitutes acceptance.

9. Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, except where the law of your part of the UK requires otherwise.
